Does beer have to be bagged in Virginia?
The ABCs of plastic bags and beer shopping in Virginia
UPDATE: Morrisey’s bill failed in committee Try to buy a six-pack of beer and leave the store without it wrapped in a plastic bag.Chances are the cashier will insist — it’s state law, they often say — on putting those suds behind the familiar veneer of one of those controversial sacks. Here’s the truth: Virginia does not mandate that cashiers bag beer, wine or any other alcoholic beverage.
“It’s not required. It is not a law,” said Kathleen Shaw, a spokeswoman for the state Department of Alcoholic Beverage Control. So, what gives? More often than not, it appears, store owners develop their own alcohol-bagging policies. Note: they seldom apply to alcohol fully enclosed in cardboard, such as 12-packs of beer.
Cashiers are either erroneously told by their employer that Virginia requires them to bag alcohol or they mistakenly equate store policy to state law. Either way, beer is bagged at nearly every supermarket and convenience store in Hampton Roads. Raj Gupta, a franchise owner of several 7-Eleven stores on the Peninsula, said he requires cashiers to bag six-packs, bottles of wine, and single cans and bottles of alcohol for a variety of reasons.
Among them, he says it’s convenient for the customer, it deters customers from drinking alcohol in the store parking lot and it prevents minors from seeing people carrying alcohol. “It’s my policy,” Gupta said. “If they don’t want the bag, they can throw it out in the trash can when they leave the store.” There are places outside Hampton Roads — the Outer Banks in North Carolina being one — that do not allow grocery stores and other businesses to use plastic bags.
Reasons vary, but proponents generally think that banning plastic bags will reduce litter and prevent animals from accidentally choking themselves to death. There are lobbying groups, such as the American Chemistry Council, that oppose such laws. The council argues that plastic bags are an “extremely resource-efficient disposable bag choice.” Virginia’s General Assembly has considered legislation on plastic bags but never enacted any statewide rules.
It will take up the matter again this year — Del. Joseph D. Morrissey, D-Richmond, introduced a bill that would impose a 20-cent tax on plastic bags. If enacted, the bill might encourage people to use canvass or reusable bags. Or people could start today — Gupta said he’ll waive the plastic bag requirement if customers carry six packs out of the store in their own reusable bag.
